What is Copyright?
Copyright is the "right to copy, publish or perform" an artistic work. It is a way of expressing the legal exclusive right of ownership, and allows artists to make a living from their creative work. Jayzen Productions is the registered copyright owner of its sound and music products. When you purchase a sound product from our website, you are given a license to use the sounds to create your own music compositions and sound designs, and to sell them royalty free.
 
Do I own the sounds?

No – you own a license to use the sounds to create your own work. The Soundfonts, Virtual Instruments, Audio Loops, Soundscapes, etc. purchased from us are licensed to you with the understanding that you will use them to create separate and distinctly unique new sounds. This means, the sounds you buy must be mixed with each other, or with other, new sounds, to create your own sounds and music. Once it is made unique in this manner, this new sound is yours. You may sell it, distribute it, market it, or give it away – that is entirely up to you.

 

Our sounds may only be used in isolation if they appear as background sound-effects in a video, movie, or computer game. This is called "sychronisation." Any other use is a violation of the license agreement.

 

 
Please explain the license...

You can use the sounds within any multimedia production for the purposes of synchronisation. Examples of usage: Computer games, television shows, films, music, e-cards, flash animations, theatre, etc.



What can I not do with the sounds?

You can not redistribute the sounds in our products as sounds by themselves, in whole or in part (as is or slightly modified) for a fee or for free.

 


What does royalty-free mean?

A standard, non-license fee agreement to utilise the sounds within any multimedia production.

 

 

Can I use Jayzen audio loops for ringtones in my cell phone?

Yes, you may use them in your own phone. But, you are not allowed to sell or give them away until they have been made unique according to the license agreement. In other words, you can not take one of our Audio Loops on its own and sell it as a ringtone... you must mix the loop with vocals or another instrument, etc. to make a new, original sound. You are then free to sell your new sound in any manner you wish.

 

 

Can I use Jayzen sound products on my website?

Yes, within the following limits... you can synchronise our products for playback only on your website, so that button rollovers make a sound for example. This type of use is OK. But you are not allowed to distribute our sounds in any way - whether you intend to give, trade, loan or sell them. You are not permitted to present our sound products in any way that would allow access to the products or sounds as downloadable audio. This would be a violation of our proprietary property rights and is therefore unauthorised without express written permission from Jayzen Productions.

 

 

Can I use Jayzen sound products in my computer game?

Yes you can, provided that the sounds are embedded in the code of your game and are not available for an end-user to access or download. If your application allows the end-user to access or download unsynchronised sounds, you should email us to arrange supplemental authorisation for the use of the products.

 

 

Can I use Jayzen sound products in my own music?

Yes, of course, as long as it has been synchronised or mixed with other audio content as required by the End User License.

 

 

Can I use your products in a video game for release in retail stores?

Yes you can. Synchronisation of our products in this manner is permitted under the terms and conditions of the License Agreement.

 


Do I have to pay you more if I include your products in a production that will be broadcast on radio or TV?

Jayzen Sound products are sold as royalty free products. This means that you do not need to pay any additional money to Jayzen Productions if a production is going to be broadcast or performed publicly.

 

 

Can your sound products be used for live theatre productions?

Yes. Our products can be incorporated into a live theatre production, either through the creation of a cued tape or CD created specially for the production, or through use of a direct cue from the original sound. These uses meet Jayzen Productions' definition of synchronisation and therefore fall within the rights granted under our License Agreement.

 

 

What about music and performing rights?

If you are working in feature film or TV and you file cue sheets for performing rights royalties for the music that you have used in your production, please credit Jayzen Sound for supplying the sound products used.

 

 

Can I copy Jayzen products to another computer?

Yes, provided that you own the Jayzen products that you want to transfer and that you will be the only person using the products. The license that you obtain with your purchase of Jayzen sound products allows you to copy the files on one computer to another for the purposes of creating audio and/or visual productions or applications. If you are setting up a multi-user audio production environment, you will need to buy a separate licenses for each workstation. What happens if I sell my computer?

If you decide to sell your computer (with its hard drive), All Jayzen Sound products MUST be removed from the disc before you transfer ownership. You are not authorised to sell copied versions of our Virtual Instruments, Audio Loops, or Soundscapes under any circumstances - this practise is an infringement of Jayzen Productions' copyright.

 

 

What am I not allowed to do with your products?

Your license does not permit the sale, lease, loan or gift of any unsynchronised Jayzen Productions audio content. This means that if, for example, you decide to sell a computer hard drive that has Jayzen Productions copyrighted audio content on to it, you must delete that content before the hard drive is delivered to its new owner.

 


Can I make a back up copy of my Jayzen sound products?

Yes. You are permitted to make a single back up copy (to another hard drive or CD/DVD) of a Jayzen Sound product for your personal use only. No one but the original registered owner may use or have access to the backup copy under any circumstances.
